WEST SPRINGFIELD -- Daniel Crespo, owner of Adult Only bookstore, 2025 Riverdale Rd., has chosen not to fight the Building Commissioners Action that he cease and desist operations.

The owner has instead opted to withdraw his application with the Zoning Board of Appeals and forego the public hearing scheduled for Aug. 23. Crespo has signed an agreement with the town to liquidate inventory and close up shop by Oct. 31, according to Patrick Moore, building commissioner.

"The matter has been resolved ... it was pretty amicable," Moore said, adding that the town made a concession by allowing the business to remain open until the fall.

Calls to Diana Sorrentini-Velez, Crespo's attorney, were not returned.

Moore explained Crespo was illegally operating Adults Only in Business A zoning district. Adult bookstores are limited to Business B district, he added.

Business B district include parts of Union and East Elm streets, Wayside Avenue and Capital Drive. The majority of Riverdale Street is zoned as Business A.

Adults Only has been in operation under Magnetic Media since Aug. 13, 2007 and was later purchased by Crespo on Dec. 9, 2008, according to the Town Clerk's Office.

The location is currently advertising liquidation of all materials and its windows are blacked out with paper.

Moore said he does not foresee any future complications with Crespo's compliance.
