The following is the legal reason why the recent Senate Legislation as to illegal immigrants should be passed. The law is not hard and oppressive. It has Equity Jurisprudence built into it, to do the Just, and Righteous Remedy, which is an act of human kindness. This is a reply to Congressman Sensenbrenner, who is the chairman of the Immigration Committee, and is a congressional representative from the state of Wisconsin. Re: Immigration Bill to be Enacted. 1. The Congressman looked at the definition of amnesty in the dictionary, and he is again amnesty, as to the Senate Bill which was passed to deal with illegal immigrants. 2. It is requested that the Congressman look up the following: A. The Doctrine of Laches B. Righteous C. Compassion D. Clemency The dictionary where you find these items which Congressman Sensenbrenner has overlooked is available, but let us comment. Who is to blame for illegal immigrants remaining in our continental United States for more than five years? It is obvious that is is our own government who failed to act, who slumbered on its rights to enforce the law, and expel those trespassers who came into the country illegally. This failure to act is called The Doctrine of Laches. These human beings that came into the country illegally married, had natural born American citizens, some of whom are fighting our battles in Iraq. If one trespasses on a path over land that he/she does not own, without interruption for 10 continuous years, that person has an Easement by Prescription. If a person builds a structure on someone else's land, and it remains for 20 years without interruption, that person becomes the owner of the land upon which the structure is built by Adverse Possession. If a human being lives in the United States without a green card for six years or more, he/she should under the Doctrine of Laches, be given a green card, provided he/she has no criminal record. It is the RIGHTEOUS and "COMPASSIONATE" ACT OF "CLEMENCY." It is the confession of our government, who has slumbered on its obligation to remove the trespasser, before he/she changed her position. We give clemency to corporate executive, public officials, why should we not give clemency to hard working honest "illegal trespassers" who have not injured or hurt anyone? As it was once said in the Senate "have you no mercy?" If the Republican Party stands for Human Rights, why the hypocrisy? Let the new green card holder use the card to earn his citizenship as described in the Senate Bill. Leonard Michelman Springfield |
